The purpose of a 1031 exchange is to allow an investor to defer — or maybe avoid altogether — the payment of federal and state capital gains tax when exchanging like-kind property. An investor places the proceeds from selling property — a commercial building, or an apartment complex, for example — with the intermediary while searching for like-kind property to obtain in exchange. If an audit reveals all 1031 rules have not been followed, the exchange will be disallowed and the investor is left to pay state and federal capital gains taxes, plus any penalties and interest assessed. Preying on the elderly, friends and relatives, John Bravata and Richard Trabulsy raised more than $50 million in three years from at least 440 investors, many of whom raided their retirement accounts to come up with cash, regulators allege. Securities and Exchange Commission filed charges last week to stop what it calls a Ponzi scheme show that Bravata, 41, of Brighton and Trabulsy, 26, of Northville used slick Internet videos and other means to separate investors from their money. Philliben and the SEC court filings said Bravata and Trabulsy promised investors returns of 8% to 12%. Pitching their fund to elderly people, many of whom raided their retirement accounts to invest, Bravata and Trabulsy raised more than $50 million from at least 440 investors since mid-2006. An investment scam in which operators use money from new investors to pay earlier investors is named for Charles Ponzi, who in the 1920s got thousands of New England residents to invest in postage stamp speculation. read more

An unprecedented number of Vietnamese colleges and universities offer e-commerce training programmes, but the country still has much to learn about the development of online businesses, according to speakers at a seminar held on August 25 by the Vietnam Information Security Association. The Vietnam Economic Times on August 25 flagged its ninth Golden Dragon Awards for business excellence from foreign-invested companies in various sectors. The winners will be enterprises dealing with various products such as automobiles, motorbikes, agro-forestry and fisheries, food, beverages, construction, construction materials, real estate, banking, insurance, machines, garments, electronics, information technology and telecommunications, oil and gas and others. The awards ceremony will be organised in Hanoi in February 2010 with sponsorship form several Government ministries and agencies, including the Ministry of Planning and Investment, The Ministry of Industry and Trade and the Vietnam Union of Scientific and Technical Associations. Deputy Head of the General Department for Vocational Training Duong Duc Lan said the contestants will compete in nine categories including information technology, web design, restaurant services, cooking, mechanical electronics, civil woodwork, industrial electronics, civil electricity and refrigeration. At an international seminar on Viet Nam’s energy development planning and strategies, held recently in Ha Noi, Hao said that in the near future, national energy policies would focus on synchronously developing an energy system, including electricity, coal, oil and gas and new and renewable energy sources. Energy development strategies would be implemented with international co-operation policies on energy imports and exports, the development of energy technology, especially for new and renewable sources, forming a competitive energy market and boosting the economical and effective use of energy, he added. Chairman of the Viet Nam Energy Association Tran Viet Ngai said that the energy sector, including electricity, had not yet attracted investors, especially those from foreign countries, because commercial electricity prices did not properly reflect production costs. Ta Van Huong, head of the MIT’s Energy Department, said that Viet Nam would expand co-operation with other regional and worldwide countries in mining coal, oil and other energy sources in foreign countries to supplement domestic energy sources. To lure investments in the energy sector, besides policies to encourage investments and solve difficulties, the Government should apply common electricity prices for both domestic and foreign businesses, they suggested, adding that power purchase negotiation procedures should be simplified to help investors save time and costs. read more
